1. Acceptance of Terms

By accessing and using Email Calculator ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Email Calculator provides a SaaS platform for creating, managing, analyzing, and exporting email marketing reports and campaign metrics. The Service includes:

  • Report creation and management with customizable metrics
  • Integration with 30+ email marketing platforms (PRO feature)
  • AI-powered campaign analysis using OpenAI (PRO feature)
  • Scheduled automated email reports (PRO feature)
  • Export capabilities (PDF, Word, PowerPoint, HTML, plain text)
  • Customizable profile settings and branding
  • Real-time collaboration and sharing features

Authentication and data storage are provided by Supabase. Payment processing is handled by Stripe. AI features utilize OpenAI's API with your provided credentials. We may use analytics services to improve the Service. Cookies and similar technologies are used to enhance your experience, manageable via our cookie consent banner.

3. User Accounts

To access certain features of the Service, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete information
  • Notifying us immediately of any unauthorized use
  • The security and proper use of any third-party API keys you provide (email marketing platforms, OpenAI, etc.)
  • Compliance with the terms of service of any third-party platforms you connect
  • All content created, shared, or exported through your account

4. Subscription and Billing

We offer both Free and PRO subscription tiers. PRO features include API integrations, AI Assistant, and Scheduled Reports. By subscribing to PRO, you agree to:

  • Email Calculator subscription (£4.99/month), and you bring your own API keys from third-party services.
  • Provide accurate billing information through Stripe
  • Authorize recurring charges to your payment method
  • Cancel your subscription before the next billing cycle to avoid charges
  • Loss of access to PRO features upon cancellation or non-payment

Free tier users can create and manage reports but do not have access to API integrations, AI features, or scheduled reports.

5. Third-Party Services and API Integrations

PRO users can connect third-party services using their own API credentials:

  • Email Marketing Platforms: You may connect platforms like Mailchimp, Klaviyo, Campaign Monitor, HubSpot, and 30+ others to import campaign data.
  • OpenAI API: You may provide your OpenAI API key to enable AI-powered campaign analysis.
  • Your API Keys: You are solely responsible for obtaining, securing, and managing your own API keys. We store them encrypted but are not liable for unauthorized access or misuse.
  • Third-Party Terms: Your use of connected platforms is governed by their respective terms of service and privacy policies.
  • API Costs: You are responsible for any costs incurred from third-party API usage (e.g., OpenAI API charges).
  • Data Access: By connecting a platform, you authorize us to access and process data from that platform on your behalf.

We are not responsible for any disruption, changes, or termination of third-party services. You may disconnect integrations at any time from your Settings page.

6. AI Assistant and Generated Content

The AI Assistant feature (PRO only) uses OpenAI's API to analyze your campaign data and provide insights:

  • You must provide your own OpenAI API key to use this feature
  • Your questions and campaign data are sent to OpenAI's servers for processing
  • AI-generated responses are provided for informational purposes only
  • We do not guarantee the accuracy, completeness, or reliability of AI-generated insights
  • You are responsible for verifying any AI-generated recommendations before implementation
  • AI chat history is stored in your Supabase database and can be cleared by you at any time using the "Clear" button in the AI chat interface

6A. Data Deep Dive Feature - Recipient-Level Data Processing

The Data Deep Dive feature (PRO only) allows you to analyze individual recipient engagement with your email campaigns. By using this feature, you acknowledge and agree to the following:

Your Responsibilities as Data Controller:

  • Legal Basis: YOU are the data controller for recipient personal data. You must ensure you have a lawful basis under GDPR/UK GDPR (consent, legitimate interest, contract, etc.) to process your email recipients' personal data.
  • Transparency Obligation: You must inform your email recipients through your own privacy policy that their email engagement activity (opens, clicks, etc.) is tracked and may be analyzed.
  • Purpose Limitation: You may only use the Deep Dive feature for legitimate email marketing analysis and campaign optimization purposes.
  • Recipient Rights: You are responsible for honoring data subject rights (access, deletion, rectification, etc.) for your email recipients under applicable data protection laws.
  • Third-Party Compliance: You must comply with the terms of service and acceptable use policies of your email service provider (e.g., Mailchimp, Klaviyo) when accessing recipient data.
  • Data Security: You must maintain appropriate security measures to protect any recipient data you export or analyze.

Our Role as Data Processor:

  • We act as a data processor on your behalf, retrieving recipient data from your connected email platform in real-time
  • We do not permanently store individual recipient engagement data on our servers
  • Recipient data is only displayed to you during your active session and is not retained after you close the Deep Dive modal
  • We implement appropriate technical and organizational measures to protect data during transmission

⚠️ IMPORTANT LEGAL NOTICE: Email Calculator is not responsible for your compliance with GDPR, PECR, CAN-SPAM, CASL, or other data protection and email marketing laws. By using the Deep Dive feature, you represent and warrant that you have all necessary rights, permissions, and legal bases to process recipient personal data. Misuse of recipient data may result in immediate termination of your account.

7. Scheduled Reports

PRO users can schedule automated email reports. By using this feature, you agree that:

  • You have obtained consent from all recipients to receive reports
  • You will only send reports to valid email addresses
  • You are responsible for the content of reports sent to recipients
  • We may suspend or terminate scheduled reports that generate complaints or bounce rates
  • Reports are sent on a best-effort basis; we do not guarantee delivery

8. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with the proper functioning of the Service
  • Send unsolicited emails through scheduled reports (spam)
  • Use others' API keys without authorization
  • Abuse AI features for malicious purposes or to generate harmful content
  • Scrape, data mine, or extract data from the Service beyond normal usage
  • Resell or redistribute the Service without permission

9. Intellectual Property

The Service and its original content, features, and functionality are owned by CORE and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Content: You retain all rights to the reports, data, and content you create or upload. By using the Service, you grant us a limited license to store, process, and display your content to provide the Service, including generating exports, sending scheduled reports, and processing AI requests.

10. Privacy Policy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand how we collect, use, and protect your data, including API credentials, campaign data, and AI chat history.

11. Data Export and Portability

You may export your reports and data at any time in various formats including PDF, Word, PowerPoint, HTML, and plain text. Upon account deletion, we will permanently remove your data, including API credentials and campaign reports, within 30 days.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms of Service. Upon termination:

  • Your access to PRO features will be immediately revoked
  • Scheduled reports will cease
  • API integrations will be disconnected
  • You may still access your account to export data for 30 days

13. Limitation of Liability

In no event shall Email Calculator, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

We are not responsible for:

  • Disruptions or changes to third-party services (email platforms, OpenAI, etc.)
  • Costs incurred from third-party API usage
  • Accuracy of AI-generated content or recommendations
  • Delivery failures of scheduled reports
  • Data loss due to third-party service failures

14. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Email Calculator makes no warranties, expressed or implied, and hereby disclaims all warranties, including without limitation, implied warranties of merchantability and fitness for a particular purpose.

We make no warranties regarding:

  • The availability or reliability of third-party integrations
  • The accuracy of AI-generated insights or recommendations
  • The successful delivery of scheduled reports
  • The security of third-party API keys beyond our encryption measures

15. Governing Law

These Terms shall be interpreted and governed by the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

For users outside the United Kingdom, your use of the Service may also be subject to local laws in your jurisdiction.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
